Unsure how the Employment Standards Act Applies to You? Today’s reality is:
  • The Ministry of Labour's Employment Standards Program is increasing its enforcement activities in the province.
  • The number of Payroll Audits and visits to all workplaces is increasing.
  • A Notice of Contravention, often discovered during a payroll audit carries a minimum penalty of $350 for the 1st notice and increases for any subsequent offences.
  • Employers and/or directors can be prosecuted under the Employment Standards Act and can be fined and/or imprisoned.
Some recent Prosecutions resulted in the following charges:
  • In November 2017, a company was charged $75,000 and the director of the company was charged $10,000 for failure to comply with an order to pay.
  • In October 2017, a company was charged $31,000 and the director of the company received a 15-day jail sentence for failure to comply with an order to pay.

We've Had and Issue


Wilkens Health & Safety Solutions (WHSS) provides assistance to those businesses that have had the unfortunate experience of having:

Non-compliance with the Employment Standards Act (ESA) can carry with it severe penalties, which can often cause a business to suffer great financial losses. A ticket issued during an inspection carries a fine of $365.00 to $1,000.00 per offence if the employer is convicted. Individual prosecutions under the Act are subject to a maximum fine of $50,000.00 and/or incarceration of up to 12 months. For those businesses that find themselves in a situation where a claim has been filed or a notice of inspection has been issued, we offer the following services:
